1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the Morning Max mobile application, website, and related services (collectively, the "Service").
The Service is operated under the name Morning Max ("Morning Max," "we," "us," or "our").
By creating an account, purchasing a subscription, or otherwise using Morning Max, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
2. The Morning Max Service
Morning Max is a morning routine, productivity, screen-time management, and accountability application.
Features may include:
Custom morning routines
Habit tracking
Alarms
App-blocking functionality
Screen Time-related functionality
Habit completion tracking
Proof photos or videos
Streaks and progress information
Accountability features
Premium subscription features
Features may change, be added, or be removed over time.
Some features require device permissions, an internet connection, compatible Apple functionality, or a paid Morning Max subscription.
3. Eligibility
You must be legally permitted to enter into these Terms and use the Service under the laws applicable to you.
If you are not legally able to agree to these Terms yourself, you may use Morning Max only with the involvement and permission of a parent or legal guardian where permitted.
You are responsible for ensuring that your use of Morning Max complies with applicable laws.
4. Accounts
Certain Morning Max functionality requires an account.
You agree to provide accurate information when creating and maintaining your account.
You are responsible for:
Protecting your login credentials
Maintaining control of your device
Activity occurring through your account
Informing us if you believe your account has been compromised
You may not impersonate another person, create an account using information you do not have permission to use, or attempt to gain unauthorized access to another user's account.
5. Subscriptions and Morning Max Pro
Some Morning Max features may require a paid subscription ("Morning Max Pro").
Available subscription plans, prices, billing periods, trial offers, and included features are displayed in the app before purchase.
Subscriptions purchased through the iOS application are processed through Apple's App Store.
Payment is charged to your Apple account in accordance with Apple's purchase terms.
Morning Max does not directly process your App Store payment-card information.
6. Free Trials
Certain subscription plans may include a free trial.
The duration and availability of any trial will be displayed before you subscribe.
Unless cancelled before the trial ends, a free-trial subscription may automatically convert into a paid subscription at the price displayed when you subscribed.
Trial eligibility may be determined by Apple and may be limited to eligible users.
Creating multiple accounts does not necessarily create additional eligibility for free trials.
7. Automatic Renewal
Morning Max Pro subscriptions may automatically renew unless cancelled.
Your Apple account may be charged for renewal according to the subscription terms displayed by Apple when you subscribe.
The applicable price, billing period, and other purchase information will be displayed before you confirm your purchase.
Apple manages billing and renewal for subscriptions purchased through the App Store.
8. Cancelling a Subscription
You may cancel an App Store subscription through your Apple subscription settings.
Deleting Morning Max or deleting your Morning Max account does not necessarily cancel an active Apple subscription.
If you cancel, you may generally continue accessing the subscription benefits until the end of the already-paid subscription period, subject to Apple's terms.
9. Refunds
Purchases made through Apple's App Store are subject to Apple's applicable payment and refund policies.
Morning Max generally does not directly control Apple's approval or denial of refund requests.
Where applicable, refund requests for App Store purchases should be submitted through Apple.
10. App Blocking and Screen Time
Morning Max may use Apple-provided Screen Time and related technologies to restrict access to applications or categories selected by the user.
You understand that:
App-blocking functionality depends on Apple's operating system, APIs, permissions, and restrictions
Changes made by Apple may affect Morning Max's ability to provide this functionality
Device settings or permissions may affect functionality
Technical failures may occasionally cause restrictions to behave differently than expected
Morning Max cannot guarantee that app restrictions will operate without interruption in every circumstance
You remain responsible for your device, its configuration, and your use of other applications.
Morning Max should not be used as the sole method of preventing access to applications where failure to restrict access could result in harm.
11. Alarms and Notifications
Morning Max may provide alarms, reminders, notifications, or other time-sensitive functionality.
We do not guarantee that an alarm, notification, reminder, or similar feature will always occur at the expected time.
Operating-system settings, battery state, device state, permissions, software errors, connectivity, or other factors outside Morning Max's control may affect these features.
You should not rely on Morning Max as your sole alarm, reminder, or notification mechanism for emergencies, medical needs, safety-critical activities, travel, employment obligations, examinations, or other situations where a missed notification could cause significant harm or loss.
12. Proof Photos and Videos
Morning Max may allow users to take or upload photos or videos as proof of completing habits.
You retain responsibility for content you submit through the Service.
You agree not to submit content that:
Violates applicable law
Violates another person's privacy
Infringes intellectual-property rights
Contains content you do not have the right to provide
Is intended to abuse, exploit, threaten, or harm others
Contains malicious or unlawful material
You grant Morning Max a limited right to host, store, process, transmit, and display submitted content solely as reasonably necessary to operate and provide the Service.
You retain ownership of your content.
13. Acceptable Use
You agree not to:
Use Morning Max for unlawful purposes
Attempt to gain unauthorized access to the Service
Interfere with Morning Max's infrastructure
Circumvent security measures
Reverse engineer Morning Max except where applicable law expressly permits it
Introduce malware or harmful code
Abuse or overload our systems
Access Morning Max using automated means in a manner that harms the Service
Use another person's account without permission
Use Morning Max to infringe the rights of others
We may restrict or terminate access where reasonably necessary to protect Morning Max, our users, or others.
14. Productivity and Wellness Disclaimer
Morning Max is designed as a productivity, routine, and accountability tool.
Morning Max does not provide medical, psychological, psychiatric, nutritional, or other professional healthcare advice.
Information provided through Morning Max is for general informational and productivity purposes.
Morning Max does not guarantee that using the Service will:
Increase productivity
Improve physical or mental health
Improve academic or professional performance
Create or eliminate particular habits
Produce financial, professional, fitness, or personal-development results
Your results depend on your individual circumstances and actions.
If you have health or medical concerns, consult an appropriately qualified professional.
15. Availability and Changes to the Service
We aim to keep Morning Max available and functional, but we do not guarantee uninterrupted or error-free operation.
Morning Max may occasionally be unavailable due to:
Maintenance
Software updates
Server issues
Third-party outages
Apple platform changes
Network failures
Security incidents
Circumstances beyond our reasonable control
We may modify, improve, replace, suspend, or discontinue features where reasonably necessary.
16. Third-Party Services
Morning Max relies on third-party platforms and service providers, which may include Apple, Supabase, RevenueCat, Superwall, and other infrastructure providers.
Your use of certain third-party services may also be subject to their respective terms.
Morning Max is not responsible for outages, changes, errors, or actions of independent third-party services outside our reasonable control.
17. Intellectual Property
Morning Max and its software, branding, logos, designs, text, graphics, interfaces, and other content provided by Morning Max are owned by or licensed to Morning Max and are protected by applicable intellectual-property laws.
Except where expressly permitted, you may not copy, distribute, sell, license, modify, reproduce, or commercially exploit Morning Max's intellectual property without permission.
These Terms do not transfer ownership of Morning Max's intellectual property to you.
18. Feedback
If you voluntarily provide suggestions, ideas, or feedback regarding Morning Max, you agree that we may use that feedback to improve or develop Morning Max without restriction or compensation to you.
This does not transfer ownership of your personal content or personal information to Morning Max.
19. Suspension and Termination
You may stop using Morning Max at any time.
You may also delete your account using the account-deletion functionality made available through the Service.
We may suspend or terminate access to Morning Max where reasonably necessary, including if:
You materially violate these Terms
Your use creates a security risk
Your use violates applicable law
Your activity harms Morning Max or other users
We are required to do so by law
Where appropriate, we may provide notice before termination.
Termination does not automatically cancel subscriptions billed by Apple. Apple subscriptions must be managed separately through your Apple account.
20. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Morning Max is provided on an "as is" and "as available" basis.
We do not warrant that the Service will always be uninterrupted, error-free, secure, or suitable for every purpose.
Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded under applicable consumer-protection law.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Morning Max will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service.
This may include loss arising from missed alarms, unavailable app-blocking functionality, loss of data, lost productivity, lost opportunities, or third-party service interruptions.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Your statutory consumer rights remain unaffected.
22. Privacy
Your use of Morning Max is also governed by our Privacy Policy.
The Privacy Policy explains how Morning Max collects, uses, stores, and shares information.

23. Changes to These Terms
We may update these Terms from time to time to reflect changes to Morning Max, our business, legal requirements, or our services.
When we update these Terms, we will update the "Last Updated" date.
Where required by law, we will provide additional notice or request consent before materially revised Terms become effective.
24. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction provide otherwise.
Nothing in these Terms deprives you of mandatory rights or protections available under applicable law.
25. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented for specific features or purchases, constitute the agreement between you and Morning Max concerning your use of the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
